These Terms of Service ("Terms") govern your use of the INOX Construction website at inoxconstruction.com.au ("the website") and the steel stair design, fabrication, and installation services we provide ("the services"). By using our website or engaging our services, you agree to these Terms.
INOX Construction is operated by INOX Construction Pty Ltd (ABN 26 615 555 354) ("we", "us", "our"). "You" and "your" refers to you, the user of our website or client of our services.
If you do not agree with these Terms, please do not use our website or engage our services.
INOX Construction provides steel staircase design, fabrication, and installation services across NSW, including:
The specific scope of work, materials, timeline, and price for each project are agreed upon before work begins, through a site measure, technical drawings, and a written quote.
You may use our website for lawful purposes only. When using this website, you agree not to:
We reserve the right to restrict access to the website at any time and for any reason.
Our intellectual property. The content on this website, including text, graphics, logos, icons, images, project photographs, and design elements, is the property of INOX Construction Pty Ltd and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content on this website without our written permission.
Project photographs. We may photograph completed projects for our portfolio, website, and marketing. We will seek your permission before photographing your property. You grant us a non-exclusive, royalty-free licence to use approved photographs in our marketing materials.
Your designs and plans. If you provide architectural plans, drawings, or design specifications, you retain ownership of those materials. We will use them only for the purpose of quoting and completing your project.
Designs we create for you. Technical drawings and stair designs we create for your project are provided as part of our service. Once the project is paid in full, these drawings become your property.
Free site measure. We provide a free on-site measure for all projects. The site measure is not a sales meeting — it is a technical assessment of your project.
Technical drawings. Following the site measure, we provide free technical drawings showing exactly what we will build. You see it, you confirm it, then we build it.
Fixed-price quotes. All quotes are fixed price. The price on the quote is the price on the invoice. There are no hidden charges or surprise extras. A quote is valid for 30 days from the date of issue unless otherwise stated.
Variations. If you request changes to the agreed scope of work after the quote is accepted, we will provide a written variation with the additional cost before proceeding. We will not proceed with any variation without your written approval.
Deposit. A deposit is required upon acceptance of the quote before fabrication begins. The deposit amount is specified on your quote.
Progress payments. For larger projects, progress payments may be required at agreed milestones (e.g., fabrication complete, installation scheduled). These will be detailed in your quote.
Final payment. The remaining balance is due upon completion of installation and your sign-off on the finished work.
Payment methods. We accept bank transfer and other payment methods as agreed.
Late payments. If payment is not received within 14 days of the due date, we reserve the right to suspend work until payment is received. Interest may be charged on overdue amounts at a rate of 2% per month.
Confirmed dates. The delivery date we confirm is the delivery date we hit. We commit to the timeline agreed in your quote.
Delays outside our control. In rare cases, timelines may be affected by circumstances beyond our control, including weather, material supply delays, site access issues, or changes requested by you. We will notify you immediately if any delay arises and provide a revised timeline.
Your responsibilities for timeline. To keep your project on schedule, you agree to:
When working with us, you agree to:
We agree to:
Workmanship warranty. We provide a standard 1-year warranty on all workmanship from the date of project completion. This covers defects in fabrication and installation that arise under normal use.
What is covered: Structural integrity of welds and joints, installation defects, finish defects that appear under normal use within the warranty period.
What is not covered: Damage caused by misuse, modification, or neglect; normal wear and tear; cosmetic scratches or marks after handover; damage caused by third parties; damage from events outside normal conditions (storms, flooding, impact).
Making a warranty claim. Contact us by phone or email with a description and photographs of the issue. We will inspect the work within 14 days and, if the claim is valid, repair or rectify the issue at no charge.
Statutory guarantees. This warranty is in addition to, and does not limit, any rights you have under the Australian Consumer Law. Nothing in these Terms excludes or limits any consumer guarantee under the Competition and Consumer Act 2010.
INOX Construction holds:
Copies of our licences and insurance are available on request.
All steel stair projects are custom. While we provide accurate technical drawings and specifications before fabrication, minor variations may occur due to the nature of custom metalwork and on-site conditions. We will communicate any material variations before proceeding.
Images on our website are of actual INOX Construction projects. Individual results will vary based on project specifications, site conditions, materials selected, and design requirements.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
To the maximum extent permitted by law:
Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. If the Australian Consumer Law applies to you, our services come with guarantees that cannot be excluded, including that services will be provided with due care and skill and will be reasonably fit for their purpose.
Home Building Act. For residential work valued over $20,000, the Home Building Act 1989 (NSW) may provide additional protections, including statutory warranties. These protections apply in addition to anything in these Terms.
Both parties agree to keep confidential any project information, pricing, designs, or materials shared during the course of the engagement. This includes but is not limited to:
Confidentiality obligations survive the completion of the project.
By you before fabrication begins. You may cancel the project before fabrication begins. The deposit may be partially refundable depending on work already completed (site measure, drawings, material ordering). We will provide an itemised breakdown of any costs incurred.
By you after fabrication begins. If you cancel after fabrication has started, you are liable for all costs incurred to date, including materials ordered, fabrication work completed, and any restocking fees.
By us. We may terminate the project if:
Upon termination by either party, any outstanding fees for work already completed remain payable.
If a dispute arises in connection with these Terms or our services, both parties agree to follow this process:
NSW Fair Trading. For residential building work, you may also contact NSW Fair Trading for assistance with dispute resolution.
Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
